In a medical negligence case, Profysen Muluti, of Muluti & Partners Legal Practitioners successfully secured a judgment in favour of our client (Ollins Mulatehi) whose right leg was amputated following surgery performed by Dr. Bakashala Kombo.
Ollins Mulatehi, a resident of Katima Mulilo in the Zambezi Region, instituted a civil claim against Enkehaus Private Hospital CC, Dr. Kombo Bakashala and the Ministry of Health & Social Services, seeking N$ 9.5 million in damages after his right leg was amputated following a botched surgical procedure. The Ministry was cited only for having interest in the outcome.
On 20 November 2020, our client was admitted to Enkehaus in Katima Mulilo due to lower abdominal pain, which was diagnosed as acute appendix by Dr. Kombo. An emergency surgery was performed by Dr. Kombo to remove the appendix. The surgery lasted for more than two hours and Dr. Kombo failed to remove the appendix due to incorrectly placed incision.
After the failed surgery our client never walked, experienced excruciating pain to the right lower leg due to complete blockage of right external iliac artery that led to stoppage of blood and oxygen supply to the right lower leg, as a result his leg died and was amputated on 29 November 2020 at Lady Pohamba Private Hospital.
On 12 November 2025, Judge Parker found that Enkehaus through Dr. Kombo breached their legal duty not to cause harm and to prevent harm being caused to Mulatehi (Mr. Ollins Mulatehi). Judge Parker granted judgment in favor of our client of N$ 1,877,038 plus interest at the rate of 20% per annum from date of judgment to date of final payment against Enkehaus and Dr. Kombo.
It is necessary to point out that our client claimed for N$ 9 million, but the court only granted N$ 1.8 million. This is because Namibian courts are conservative in awarding damages compared to South African courts. However, this award in Namibian precedence is at highest scale on medical negligence.
